After more than 34 years in real estate, I've learned that successful negotiation involves much more than agreeing on a purchase price.

Every property, buyer, and seller presents a different set of circumstances. Sometimes the greatest challenge isn't price at all. It's resolving permitting issues, structuring financing, managing risk, or finding a creative solution that allows both parties to accomplish their objectives.

The following are four examples from actual real estate transactions in which strategic negotiation and problem-solving helped produce successful closings.

1. Creative Seller Financing for Furnishings

The Challenge

A seller wanted to sell a property along with its furnishings and had a specific financial outcome in mind. The buyer was interested in the property but had different priorities regarding the real estate purchase price and financing terms.

The Solution

Rather than treating the property and furnishings as a single negotiation, we structured the transaction to address each component separately.

The real estate purchase was negotiated on terms acceptable to the buyer. The furnishings were handled through a separate, seller-financed promissory note that included monthly payments and a balloon payment at a negotiated future date, with the appropriate disclosures.

The Outcome

The buyer obtained acceptable real estate purchase and financing terms, while the seller achieved the desired furnishings price through a separately negotiated financing arrangement.

The Lesson: Sometimes successful negotiation isn't about changing the price. It's about changing the structure of the agreement.

2. Protecting a Buyer Through an Escrow Holdback

The Challenge

Unpermitted improvements created an obstacle to closing. The buyer needed protection, while the seller wanted to complete the sale without unnecessary delays.

The Solution

We negotiated an escrow holdback arrangement that allowed the transaction to close while the seller remained responsible for addressing the outstanding work afterward.

Importantly, the escrow holdback exceeded the estimated cost of the necessary corrections, providing an additional financial cushion against potential cost overruns.

The Outcome

The transaction successfully closed with an agreed-upon arrangement for addressing the outstanding improvements.

The Lesson: Effective negotiation means identifying potential risks and developing solutions that protect the client's interests while keeping the transaction moving forward.

3. Resolving Unpermitted Improvements Before Closing

The Challenge

A property had improvements with outstanding permitting issues. These issues created uncertainty for the buyer and threatened to delay the transaction.

The Solution

Rather than allowing the problems to derail the sale, I coordinated with previous contractors and city representatives to identify and address the outstanding requirements.

We worked through the necessary permitting processes, addressed applicable fines, and coordinated the opening and closing of permits for the improvements cited.

The Outcome

The permitting issues were resolved, allowing the buyer and seller to proceed to closing.

The Lesson: Sometimes the most valuable negotiation skill is knowing how to bring the right people together to solve a problem.

4. Bridging a Valuation Gap Through Creative Seller Financing

The Challenge

A seller wanted a price that was potentially above what the prevailing market would support through a conventional sale.

However, the property offered unusual characteristics: substantial land, no homeowners association, and two different zoning possibilities.

Those features made the property particularly attractive to a buyer with specific long-term needs.

The Solution

We identified a buyer who valued the property's unique characteristics and intended to own and use it rather than purchase it for a quick resale.

To bridge the difference between the seller's price expectations and conventional financing considerations, we negotiated a seller-financing arrangement.

The buyer made a substantial down payment, and the seller financed the remaining balance with a balloon payment due at a negotiated future date.

Both parties understood that future property appreciation was uncertain and not guaranteed.

The Outcome

The seller achieved the desired transaction terms, and the buyer acquired a unique property that met their long-term needs.

The Lesson: Understanding what makes a property valuable to the right buyer can be just as important as understanding comparable sales.

What These Negotiations Have in Common

Although these transactions involved very different circumstances, they illustrate the same approach to real estate negotiation:

  • Understanding each client's priorities before developing a strategy.

  • Looking beyond the purchase price to consider financing, timing, risk, and contractual terms.

  • Coordinating with appropriate professionals when transactions become complicated.

  • Identifying creative solutions while keeping the client's interests at the center of the negotiation.

  • Recognizing that every transaction requires its own strategy.
